Defeated plaintiff’s motion to bifurcate trial. Successful in suppressing statements against interest and defendant admissions. Three-day trial to verdict.
27-24 Tavern Corp. v. Dutch Kills Centraal, et al., 14 Civ. 1625 (FLB), E.D.N.Y. – Lead attorney representing plaintiff world-renowned cocktail bar in action against competing cocktail bar for Lanham Act Trademark Infringement and Unfair Competition. Two-day evidentiary hearing on preliminary injunction motion. Case settled through mediation.
People v. Deondre Ellis-Vasquez, Indictment No. 2373/2014 – 8 Count Indictment: Attempted Murder Second Degree, Multiple First Degree Gang Assault counts, Possession of Loaded Firearm. Mr. Ellis-Vasquez was one of approximately 115 alleged gang members arrested in the largest gang bust in New York history in June of 2014, part of Operation Crew Cut. Plea to 1 count of Criminal Possession of a Loaded Firearm in the 2nd Degree (C felony) and 1 Count of Conspiracy in the 3rd Degree (D felony), sentenced to 4 years incarceration.
People v. Gregory Manganello, Indictment No. 1805-2014 – 17 Count Indictment: Multiple First Degree Criminal Sale of Controlled Substance (A1 felony) counts – cocaine. Plea to 1 count of Criminal Possession of Controlled Substance (B felony), sentenced to 2 years incarceration. Served 9 months with SHOCK Program.
United States v. Benito Del Rosario, 12 Cr. 81 (KBF), S.D.N.Y. – 1 Count Indictment: Conspiracy to Distribute 30 kilograms of heroin. Assistant trial counsel. Four-day trial to verdict.
United States v. Frank DiMattina, 12 Cr. 705 (JBW), E.D.N.Y. – 5 Count Indictment: Conspiracy, Extortion, and Firearms. Assistant trial counsel. Four-day trial resulting in acquittal on 3 counts. Remaining 2 counts overturned on appeal.
